Terms and conditions of Old for New programme
of FRITZ.com GmbH, Alt-Moabit 95, 10559 Berlin, shop@fritz.com, entered in the Commercial Register of the District Court of Berlin-Charlottenburg under HRB 111009 B, represented by managing directors Jan Oetjen and Jan-Christian Werner, VAT identification number: DE418843475 (hereinafter ‘Provider’).
Section 1 Subject matter of Old for New programme
Under the Old for New programme, the Provider offers eligible customers (see Section 2) the opportunity, when purchasing a new FRITZ!Box in the Provider’s online shop at fritz.com, to submit a FRITZ!Box that meets the requirements set out in Section 3 and is eligible to participate (also referred to below as the ‘old device’) and, once it has passed inspection, to receive cashback in the amount shown on the product details page at the time the new FRITZ!Box is purchased.
The new FRITZ!Box is purchased from the Provider at the regular full retail price. The cashback amount due if the cashback requirements are met is not deducted directly at the time of purchase, but is instead paid out retrospectively after the submitted old FRITZ!Box has passed inspection.
The Old for New programme applies exclusively to selected FRITZ!Boxes (see also Section 3). In particular, other products such as repeaters, Mesh Sets, smart home devices, gateways, powerline adapters, Wi Fi sticks and other accessories are not eligible to participate.
Section 2 Conditions of entry
Eligible to participate are natural persons aged 18 or over who are resident in the Federal Republic of Germany and who, under a purchase contract via the Provider’s online shop, purchase from the Provider a new FRITZ!Box marked as part of the Old for New programme.
Participation requires that, when purchasing the new FRITZ!Box, the model of the old FRITZ!Box to be returned (old device) is correctly selected in the dropdown menu provided on the product detail page.
Participation in the Old for New programme is only possible once per customer/customer account, i.e. each customer may return only one (1) old device as part of a new purchase and receive cashback for it. Multiple entries, including across multiple orders, different customer accounts, delivery addresses or payment methods of the same person/household, are excluded. The Provider reserves the right to verify this and, in the event of suspected misuse, to request supporting evidence. If there are justified doubts, the Provider is entitled not to pay out the cashback or to make the payout conditional on the submission of further evidence. In the event that a customer has unlawfully received cashback, it must be repaid to the Provider without delay, and the Provider is entitled to reclaim it from the customer.
The cashback can be combined with a valid employee discount. The cashback will be granted irrespective of whether an employee discount is used, provided that the terms and conditions of the Old for New programme are met. A cash payout or any other form of offsetting the employee discount is excluded.
Section 3 Eligible and excluded devices
Eligible to participate are exclusively FRITZ!Boxes that are the customer’s sole property (see also Section 4), can be selected via the drop-down menu on the relevant product detail page, and meet the requirements set out in this Section 3.
Expressly excluded from the Old for New programme are:
(Former) Provider FRITZ!Box devices, i.e. devices provided by an internet/telecommunications provider (e.g. devices that were supplied to the customer free of charge or at a reduced price, or sold to them as part of a provider contract),
Rental devices or devices that are in the (co-)ownership of a third party (e.g. landlord, provider or leasing company),
FRITZ! products that are not FRITZ!Box models, such as repeaters, Mesh Sets, smart home devices, powerline adapters, gateways, Wi-Fi dongles, SFP modules and other accessories.
The Provider reserves the right to check, based on the serial number, device identification, type plate or other characteristics, whether the device is a provider device or a rental device. If such a device is identified, or if there are justified doubts, no cashback will be granted (see Section 6) and the Provider is entitled to reclaim any cashback already paid out. The Provider is, in particular, entitled to request additional evidence or information from the customer, such as suitable proof of ownership. The customer is obliged to submit these within a reasonable deadline set by the Provider. If no documents and/or no sufficient proof is provided within the specified deadline, the cashback may be refused or any cashback already paid out may be reclaimed.
Section 4 Proof of ownership
By participating in the Old for New programme, the customer confirms that the old FRITZ!Box sent in is their sole property and is free of any third-party rights, and in particular was not provided to them by a third party under a rental, leasing or provider contract.
The Provider reserves the right, in case of doubt, to request suitable proof of ownership (e.g. a proof of purchase).
Section 5 Procedure for the Old for New programme
Purchase and selection of old device: When purchasing a new FRITZ!Box, the customer selects the model of an eligible old device in the online shop on the relevant product details page or on the ‘Old for New’ landing page. The customer must purchase the new FRITZ!Box at the regular full retail price.
Return of the old FRITZ!Box: The customer must send the old device to be returned to the Provider at their own expense and risk. For the return, the customer can also use the return label sent to them by the Provider via email after completing their order, which would make the return of the old, eligible FRITZ!Box free of charge – however, the shipping risk remains with the customer. The old FRITZ!Box must be returned to the following address within 30 days of receiving the return label: Fritz.com GmbH, c/o DHL Home Delivery GmbH, ALTGERÄT, Marienberger Str. 210, 38122 Braunschweig, Germany.
Acknowledgement of receipt: Once the return has been received, the customer will receive an email confirmation.
Inspection: The Provider checks whether the submitted FRITZ!Box is an eligible device in accordance with Section 3 and whether the other requirements of the Old for New programme are met.
Refund: If the inspection result is positive, the cashback will be reimbursed in the amount stated on the product detail page at the time of purchase (usually within 7–10 working days after receipt of the return). The refund will be issued using the same payment method the customer previously used to pay the Provider for the new FRITZ!Box.
If no return is made within the period specified in Section 5, the entitlement to the cashback shall lapse without replacement; this shall not affect the purchase contract for the new FRITZ!Box.
The Provider also reserves the right not to grant the cashback if:
the submitted FRITZ!Box is not an eligible product within the meaning of Section 3,
the customer has already participated in the Old for New programme (see Section 2 (3)),
reasonable doubts exist regarding the customer’s ownership of the FRITZ!Box.
If participation in the Old for New programme is rejected, the customer will be informed of this. If the device submitted does not meet the requirements of the Old for New programme, the Provider will inform the customer of the reasons for the rejection and, where necessary, ask them to provide suitable evidence within a reasonable period. If the customer does not provide appropriate proof within this period, the submitted device will be disposed of or destroyed by the Provider, provided that the Provider has informed the customer of this. Alternatively, within the specified period the customer may request that the Provider return the device at the customer’s own expense. If the Provider does not receive any response from the customer by the deadline, the customer’s consent to dispose of or destroy the device shall be deemed to have been granted.
Section 7 Data privacy
The personal data collected as part of the Old for New programme (e.g. name, address, bank details, order data) will be processed solely for the purpose of implementing the Old for New programme and will not be passed on to third parties unless this is necessary for its implementation (e.g. shipping service providers, payment processing). The customer is solely responsible for deleting any personal data on the old device they send in. The customer must delete personal settings and personal data from their FRITZ!Box before sending it in (e.g. by resetting the FRITZ!Box to the factory settings).
Section 8 Liability
The Provider shall not be liable for any loss of, or damage to, the old FRITZ!Box sent in during transit, unless this is due to wilful intent or gross negligence on the part of the Provider or a shipping service provider commissioned by it. For shipping, it is recommended to use the shipping label with tracking provided by the Provider, but this is by no means mandatory.
Section 9 Duration and termination of the Old for New programme; final provisions
The Provider reserves the right to adjust the cashback amount as part of limited-time promotions or to suspend it temporarily. The cashback amount communicated at the time of purchase of the new FRITZ!Box on the product detail page or in these terms and conditions shall be decisive.
The Provider reserves the right to amend, restrict or discontinue the Old for New programme at any time with effect for the future. Customers’ existing entitlements from ongoing participation in the Old for New programme are not affected by this.
Legal claims are excluded insofar as permitted by law.
The programme is subject to the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
Should any provisions of these terms and conditions be or become invalid, the effectiveness of the remaining provisions remains unaffected.
